Does anyone know who these expert witnesses are? 4. Consistent with the Parties’ oral stipulation made at the status conference, the qualifications of the Government’s two experts, Michael Tu and James Marsh, [DE 25, 26] are not contested and the Court accepts them as qualified experts;

Mr. Tu is a Senior Engineer with the U.S. Department of Commerce, Bureau of Industry and Security (“BIS”). In his role, Mr. Tu assesses and makes license determinations for whether a particular item for export requires a Department of Commerce license.

In his current role at the Defense Department, Mr. Marsh provides technical assessments of national security risks that help determine whether a Department of Commerce license would be granted for exporting rebreathers, among other dual-use items. Mr. Marsh was previously a Commander and Chief Engineer in the United States Navy and has Masters Degrees in both National Security Studies and Military Arts and Sciences.​
