Ok, a co-worker of mine just mentioned that Texas is the only state legally allowed to fly their state flag higher than US's. However, most do not, but they do fly their flag at equal height. I did some research on the net and it looks to be valid.

Any Texans care to comment on this? I know you didn't write the law, but personally I think that is a crock a BS. All flags should be under the US flag... POW flags are, the other 49 states are...

I have a hard time understanding why Texas has this law. Please don't tell me how Texas is special, bigger, etc etc..... It is no different than any of the other states..even Wisconsin!

Texas is special, bigger, etc etc.....

As you mentioned ... nobody in TX actually does fly their flag higher. It speaks volumes that Texans don't need a LAW to tell them how to be patriotic.... they do it right (DIR) even though they are legally allowed to do it wrong !

I do know my history,

The "Republic of Texas" agreed to join The US of A. after winning their independence from Mexico.

Having once been a Country of their own, they have a few extra privileges they negotiated.

Beware, The US could cut Alaska in half and make Texas the 3rd largest state. Thats all I got.

Yes, but Texas also has :A recently passed anti-crime law that requires criminals to give their victims 24 hours notice, either orally or in writing, and to explain the nature of the crime to be committed...
and
It is illegal to take more than three sips of beer at a time
while standing.

The Texas capitol dome is taller than the one in Wash DC...hell, we have a single ranch larger than Rhode Island...so, yeah, I guess we are bigger...

True - a pointless statement, but true.

Texas was an independent republic, much bigger than it is now, and was admitted under treaty with special rights not granted to other states. For example, we had a legal right to leave the Union and join the Confederacy, and forcing us back after the defeat of The South was not totally legal. It was just done; winners can make new rules, of course.

It is commonly mistakenly thought that The Lone Star Flag is the only state flag that can be legally flown at the same height as the U.S.National Ensign, but this is indeed incorrect. Any state may do so. I have never heard any claims that we could fly The Lone Star higher than the National Ensign. Indeed, regulations specify otherwise:
from http://www.ushistory.org/betsy/more/texas.htm - "If the state flag and the flag of the United States are displayed on flagpoles or flagstaffs at the same location:
the flags should be displayed on flagpoles or flagstaffs of the same height;"

I flew The Bonnie Blue at a motel on a dive trip to North Carolina this fall, and some other lodgers asked about it. I told a short version of the story, and pointed out that it's still seen in The Lone Star Flag. When I asked where they were from, they responded North Carolina, and I answered: "Oh, then - it's still found on your state flag, too."

Where are you getting your information...?!

Ever notice that you never have to ask a Texan what state he's from. It's always on his SB Profile here. If there's no location given with a member's number of posts, he's not in Texas.

This came from the same website site as mentioned by Dandydon:

4. When flags of States, cities, or localities, or pennants of societies are flown on the same halyard with the flag of the United States, the latter should always be at the peak. When the flags are flown from adjacent staffs, the flag of the United States should be hoisted first and lowered last. No such flag or pennant may be placed above the flag of the United States or to the right of the flag of the United States.

Well put, DandyDon!

I saw a program on the history channel about the US flag. It mentioned all of the rules of flag etiquette. And it mentioned the the Texas flag can be flown at or above the US flag. It is because of an agreement when Texas a republic, joined the United States. The agreement was made by both parties involved. I have never seen it flown higher and probably won't. Texas unlike any other state was an independant nation before it joined the union.
I believe there is still a provision inforce that would allow Texas to leave the union. Been a long time since I've been to a Texas history class so I could be wrong.
