i would like to discuss the issue of whether or not dive shops charge state sales taxes for out of the country shop trips.

We are planning a out of the country liveaboard next year. If divers pay the boat directly, they do not pay state sales tax. However, if they pay us, we are under the impression that we also have to charge state sales tax.

That’s a problem in Texas. Flower gardens trips are not taxable, like your overseas trip. But you are selling a taxable service according to the state of Texas. You could make an argument that you are only providing part of the service in Texas, so only part is taxable, but this is a question better asked of your accountant. After you do a little google-fu.
