by the letter of the LAW we are innocent untill proven guilty, lol, so
names and faces are(by law) not suppose to be reveled untill that of the accused is indeed a fact,
and or found guilty, SUPPOSEDLY!!!!!!

really? in what parallel universe? ;)

michael jackson hasn't yet been proven guilty, yet his trial is all over the news.
so was OJ's, Peterson's, you name it...

sorry, you're wrong. the names and faces of accused people are released to the
public on a daily basis across the USA, and there's no law that says they have
to first be proven guilty

That is such an open door description. "sexual or indecent" ...who decides what is "indecent" or not? once again is an interpretation thing

It's not about interpretation but intent.

Even in Canada - only someone who is a young offender (under 18) cannot be identified... Adults, never heard of it!

Who determines "intent" how do you knwo what someone is thinking? you cant possibly prove" "intent"

LOL!!! - sometimes I wish I could see the world that way.... You're idea of sensitive is something I wish I could do... but I have too much empathy to not see it for what it is - insensitive. (here comes the country songs....) I do wish you well Aaron.

well, you can't prove anything. so... let's strike all laws, they're just interpretations
anyway

and by the way, you are wrong. intent must be proven EVERY SINGLE TIME a
prosecutor takes a case to a jury that requires intent, which include, among others,
first degree murder.

Never heard of people being accused (and convicted of) intent to [insert whatever]?

I'm not going to argue semantics with you. It's too easy to ignore or push aside truthful accusations on 'technicalities'.

My point is that its very easy to ruin someones life by making "false" or "misleading" accusations. thankfully PADI did the right thing and banned this guy. But look at Kobe Bryant. did he rape that girl? not sure, the case was dropped but he will always be viewed by society as a rapist.

honestly i don't know what to think about this issue...

i'm a little bit uncomfortable with not letting the accused post his side of the story here. i tend to believe that its not inconceivable that its a fabrication and that PADIs investigators might even have been duped. and this goes, for me, beyond a discussion of gender and sex and rape, but just to the pervasive levels of fraud all over our society, from phishing attacks to fingers in wendy's chili. i'm just naturally highly cynical of claims which initially seem a little outrageous.

at the same time if this really happened, then i'd like him rotting in a jail somewhere, ideally in solitary isolation and don't need to read anything he has to say. my cynicism certainly cuts both ways in that i'm sure that there are people out there "pushing the envelope" for sexual assualt, as disgusting as that is.

a possible, and fair, solution to this would be to just pull all threads like this off of scubaboard since we can't ever hope to be fair and balanced in this forum and should just skip it. but, again, if the attack did happen the victim certainly shouldn't be silenced.

quite an ethical mess for scubaboard...

that's my 100 psi...
