New liability agreement

You know with all of these $17mil lawsuits, it occurred to me that someone should put together a better liability release agreement to protect the dm's from boneheaded divers.

Simply because one is sued, doesn't mean the court won't uphold the release. Any idiot can file suit and ask for whatever he/she wants. Suits have been filed against God and Satan only to be dismissed (usually for lack of personal jurisdiction).

It's hard to imagine a release as comprehensive as the scuba release. The real issue is people's conduct and expectations of injured divers and their next of kin.

I'm considering a clause in the learning agreement stating that if I am held liable for anything pertaining to their class that the exact amount of the awarded damages and legal fees will be added to their bill. Also added to their bill would be all costs associated with the recovery of replacement of equipment not returned as a result of their failure to survive a dive.

That's awesome. Love the checkbox for the "Attractive spouse...". Reminds from a scene from Oceans 11 that always cracks me up. They are talking about some guy that died - one of 'em goes, "Sorry to hear that - did you send flowers?" The other guy goes "Nah, but I dated his wife for awhile". For some reason it really cracks me up.
