I almost always read every post in full before replying. Didn't even bother this time. Just another law. Another regulation, permit, fee (I guess), and a reason for some politicians somewhere to debate something and pass a law. What law will be removed now so we have the same number of laws as before? Isn't that what they always do????? Yes, here in NS we NEED a snow tire law (sarcasm). The fact that we never needed one for 100 years doesn't matter, does it?
 
Where does the authority to do this come from? What section / article of the constitution grants the Feds the power to do this?

Nice try but the MAGNUSON-STEVENS ACT is not part of the Constitution and is probably unconstitutional itself. It maybe an extension of that act but, it doesn't make it constitutional. We live with many things that are not constitutional. We don't give it much thought unfortunately.

In RI free and unencumbered use and access of/to the ocean is a state constitutionally protected right. Where does the Fed get the authority to violate a states constitution? Is this America or did I wake up in the old USSR?

From the RI Constitution:
Section 17. Fishery rights -- Shore privileges -- Preservation of natural resources. -- The people shall continue to enjoy and freely exercise all the rights of fishery, and the privileges of the shore, to which they have been heretofore entitled under the charter and usages of this state, including but not limited to fishing from the shore, the gathering of seaweed, leaving the shore to swim in the sea and passage along the shore; and they shall be secure in their rights to the use and enjoyment of the natural resources of the state with due regard for the preservation of their values; and it shall be the duty of the general assembly to provide for the conservation of the air, land, water, plant, animal, mineral and other natural resources of the state, and to adopt all means necessary and proper by law to protect the natural environment of the people of the state by providing adequate resource planning for the control and regulation of the use of the natural resources of the state and for the preservation, regeneration and restoration of the natural environment of the state.

Section 24. Rights not enumerated -- State rights not dependent on federal rights. -- The enumeration of the foregoing rights shall not be construed to impair or deny others retained by the people. The rights guaranteed by this Constitution are not dependent on those guaranteed by the Constitution of the United States.

I was thinking the same thing.

It would seem too many folks are happy to have the government dictate what 'freedom' actually is these days, provided the entitlements keep flowing and American Idol is not interrupted.

It is disturbing to think that my children will probably not be allowed by the government to fish at all in the not so distant future over the objections of greenies that feel bad for the fish and other such nonsense.

I happily buy my fresh water fishing license, and a trout stamp that I'm not required to have because I catch and release by choice. The trout stamp fee goes into an exclusive account that supports the state owned trout hatcheries. We also have the resources of URI which we fund with our tax dollars to assist with the fisheries here in RI.

These are things worth paying for. This Salt water license is just a bunch of fish counters. Call me crazy but I think they are really a bunch of fishermen counters and this is an effort to see if it's worth doing this to create a new revenue source. Also how much will we pay to be able to fish unmolested by government agents? What is the ceiling before revenue drops off?
 
I grew up fishing in Connecticut, and New Nork, a state that taxes you to extreme and "permits" you to death. When I snowbirded in Florida in '02 I was absolutely shocked to find I needed a license to fish SALT WATER. And in AL, MS, LA and SC as well. Is this the norm?

There are only three States and several territories left that do not have a saltwater license. That seems to be the ultimate result of the regulation I posted above. Force the States to do the work of supplying NOAA with the data and create a revenue stream for them. Maine is the only State so far that has created a "free" Registry. New Jersey is in the legislative end game for a "truly" free Registry.
