I just talked to Mike and he wants everybody who was at this year's Guinness to understand his $2500 offer. Here it is:

Next year, Mike will put in a hopper the 794 diver names who attended this year's Guinness and on the Sunday of the event, he will draw out one name. If that name registered and paid within 30 days of this year's event (post marked on or before Aug. 17, 2009) that person will win $2500! If you want to be in for this $$$, register before Aug. 17, 2009. Even if you were part of the 794, and don't register before the deadline date, you're out of luck. GET REGISTERED. IT WOULD BE COOL TO HAVE ONE OF THE GLWC MEMBERS WIN THIS JACKPOT.

What happens if the name selected is not at the 2010 event or is there but did not register within 30 days? Does he keep picking names until he finds a person who meets the criteria or does Mike get to keep the money if the name selected doesn't meet the criteria?

The only people eligible for this drawing are those who attended this year's event. If the person whose name is drawn is not present, or did not register before Aug. 17, 2009, then another name will be drawn until a winner is declared. You must have attended this year's event, be present at the drawing, and registered before the deadline date. Hope this clarifies even more.

That helps. I understood the first part. I wouldn't be eligible and I understand that. I was asking to clarify because I figured others who are eligible might have the same question. The key point is that Mike will keep drawing names until he finds one who qualifies. That's an important point. If you did it this year and plan on doing it next ... REGISTER NOW! That's a pretty sweet award.

Is that legal? I was of the understanding that all raffles, lotteries, etc had to be open to everyone.

It is open to everyone .... everyone who attended this year and signs up for next year within 30 days. I believe you can define the "group" that makes up the raffle as long as the criteria is objective. What you can't do is exclude within an objectively defined group.

I am just asking. I was under the assumption that companies that offer promotions through any form of gambling (lottery, drawing, raffle) could not exclude anyone. This is the reason that companies like Coke allow you to mail in entry forms without purchase of product. The advertised drawing cannot have barriers.

Just saying. Worth thinking about. What do I know.

I'm not a lawyer, but I will run your question past Mike and maybe he can check it out. At the Sun. gathering in the big tent, it looked unanimous as to who will participate next year. In order to spur commitment, Mike made this offer to the group. Divin' Hoosier sounds reasonable in his conclusion, but heck, you know how the law can go sometimes! When I find out, I'll post.

I think I figgered out a way to be SURE it goes down in the record books next year.

Let's combine the record attempt with our annual New Years Day dive!

Most people welcoming in the new year by diving! Just think!
