The family of a woman who died diving off the Keys on Aug. 6, 2011 -- along with another diver -- has sued the dive operator, the boat captain and the other victim's estate, the Palm Beach Post reported Monday.
Judy Boone, 53, of Wellington and Kevin Moss, 43, of Boca Raton died together on the deep ledge at Crocker Reef, about 60 below the surface off Plantation Key.
Boone's family claims David Leith, the operator of the dive boat, gave Boone bad dive gear and didn't monitor her or the other divers while they were in the water, the Post reported. The newspaper says the family also claims Moss was negligent because Boone died while trying to help him when he ran into problems underwater.
At the time, authorities said the two were among five divers gathered for a reef trip. Leith ran the boat, a 25-foot Bayliner named Bob, as a favor to Mariann Radwan, 54, who organized the trip.
Moss apparently ran low on air on the group's second dive and had trouble dealing with newly purchased gear that included a dive-weight system integrated into his buoyancy compensator. Boone died while trying to render assistance by trying to share her air with him.
Moss suffered from Parkinson's disease and exhibited some symptoms but reportedly was a certified diver with hundreds of logged dives. Relatives told the South Florida Sun-Sentinel that Moss exercised regularly and was physically fit.
The pair died on their second dive of the day.

so why is the family of Boone suing the Moss family estate. The facts that were written said that Boone was trying to render assistance in an OOA, that type of thing is normally done willingly. And did Boone not break the second rule of diving?, "take care of yourself first"

Should Radwan not be the one being sued here as the trip organizer?
 
Seems that the family of Moss ought to sue the family of Boone for failure to render proper assistance. Why would anyone get sued in this case. It is obviously (as the Brits would say) a case of death by misadventure. Both deceased were participating in a risky sport and dies. Neither was at fault for the other dying, and I can only assume that Boone attempted to render assistance willingly, no one coerced her to stop and help.

But then, some folks are just greedy....
