Hey Mike - I too am relaxed, just opinionated...my opinion is he needs to rot in hell....and I hope he reads that.

I hope he gets a better deal in court than he has on this board though I won't get my hopes up too high.
 
Wow, that's off topic but why do you feel that you need a dive shop to tell you how to dive? I don't dive with a dive computer.

why need a dive shop to tell me how to dive? LOL don't they already? What law say's you need to be certified to scuba dive ??

I truly hope he finds court to be similiar to this board --
 
Maybe. Or maybe we have someone who had, or thought they had, a computer problem and went back to the boat to fiddle with it and after fiddling it worked?

So, if he came right out & said that his battery was in backwards, after being able to read 3500 psi before the first dive, showing the battery was, in fact, working properly, your position would be that he lied about flipping the battery???

so I went back an I you know casually told Uzi ah said you know well ‘here’s your quarter’ and I you know ‘don’t tell anybody but I had my battery in backwards’ ah so you know that problem was solved,

Just want to see if I can do the multi-quote thing. This has been explained to you ad nausium. As your positions are disproved, you grab another. A bunch of pages back you were sure his ears were exploding from being unable to clear as he darted down to get to his wife until it was pointed out that his computer's profile showed he never made the move. Now, he had too much air in his BC to make the move. Trolling a possibility???

no I mean I cause I I was breathing so hard you know if you look on my computer the breathing rate is as, it’s as high as it’ll get

I'm just wondering if the computer profile will show his air consumption. If his breathing rate shows slow & steady, that could be another damning piece to the puzzle. I imagine the computer will show this but I don't dive AI so does anyone with an AI computer know if this is how it works.

Does the defendant have the right to not testify or is he made to take the witness stand in Australia?


Everything in that transcript was UI...Good lord, they should prosecute him for just for the "You knows"

He would be forced to address his inconsistencies if he were made to take the stand. Here in the US, the defendant does not have to testify.

No computer profile published, that I know of. The only info on the computer is what the police have given in interviews. It may be out there, I'm not the best searcher though.

My Uwatec does give the full profile of the dive and when I breath heavily. During the dive it beeps at me and displays a pair of lungs in the lower right - basically telling me to clam my ass down. you can see this when you down load the profile to the PC. But still not knowing what kind he used leaves a big question.
 
Perhaps he got that reading from his “low tech” gauge. Most people I know who dive with computers that have these electronic bells and whistles still dive using traditional gauges as well. In fact most (all?) of us who do dive with computers have the option of reading our depth from both the gauge and the computer.

Not in my case, I dive with a computer, a bottom timer and an SPG only.

The defendant does not have to testify. Under law he has the right to remain silent at trial, but in Queensland, unlike other states here, the judge and the prosecutor may comment on this and adverse inferences may be made where the evidence establishes a prima facie case [and] the defendant could reasonably have been expected to testify.
