An unopposed motion was made Tuesday for a 60 day continuance on sentencing.

On good authority I've been informed that Dustin McCabe was sentenced to 100 months and 3 years probation.

With time served he's looking at about 8 more years, less any parole: "Federal inmates serve an average of 85% of their sentence before becoming eligible for release... federal inmates may be eligible for a number of other programs and activities that can reduce their sentence"

I attended the hour and a half long sentencing hearing yesterday in Federal court. Dustin was sentenced to 100 months (the sentencing guidelines suggested a sentence 51-78 months with the defense pushing for low end and prosecution seeking enhancements to high end), served consecutively and followed by 3 years probation. There will be a restitution hearing on October 30th and any ordered restitution is to be repaid at 50% of income while incarcerated and 10% of income upon release.
