I have sympathy with Aqua Logic as I had a similar experience with Undersea Breathing Systems.

My dealings with UBS started shortly after DEMA in November 2003. I received a quotation of $10,700 for a Nitrox system and was offered a 10% discount if full payment was received at the time of ordering. I placed my order in January and my credit card was charged. Delivery was promised in 4 to 6 weeks.

Several e-mails and phone calls later I still did not have a Nitrox system and in May I canceled the order and asked the credit card company for a reversal in charges. Shortly after this a shipment was sent by UBS but I do not know what it is as we returned it to sender without clearing it through customs.

In mid October I finally got my money back through the credit card company and that was the end of my dealings with UBS.

Good luck to Aqua Logic - I hope you can somehow manage to get your money back!

This same letter was cut and pasted from an original letter he gave to my attorney, and we will give you the same response as we gave back in October.

1. He never mailed an invoice to us with a delivery date on it. It was only then when our attorney informed him that we were going to sue him that he sent our attorney an invoice;

2. We were promised that the compressor would be installed within 2-3 weeks; We phoned him and said it would be another week; called again, no response.

3. Left phone messages, e-mails and wrote letters, no response;

5. On September 3rd and 4th 2004, Hurricane Frances ripped off the roof of our facility located at Marlin Industrial Park located at 3599 23rd Avenue South, Bay 9, Lake Worth, Florida.

Bill Delp writes: On October 19, 2004, Undersea Breathing Systems receives a letter from Aqualogic’s attorney demanding that we immediately return all funds.

We had been calling, writing and e-mailing and had no response from him, what else should we have done?? Bill we really don't trust you and can't trust your word, we are hesitant to do business with you after all that has happened;

Bill Delp writes: Even if Undersea Breathing Systems were to deliver the system immediately, Aqualogic still couldn’t use it because they have never completed the necessary upgrades to their Electric Service required to power the DNAx System.

Not true we have been ready to go since October!!

Bill the time that it has taken you to write this letter you could of installed our nitrox machine.

How about you give us a call tomorrow to settle this. It's been what 7 months and you haven't called us???

All we ever wanted was what rightfully ours, we demanded our money back and you said you wouldn't refund us?? I think this is really sad that it has come down to this, having to go threw other people to resolve this matter when all it takes is one phone call or an e-mail. I can't throw the compressor in my BMW, I will give you one last chance! If my compressor is delivered to us this week, I will stop seeking outside sources. If not I will pursue this even further, I'm not afraid of you, and I will use whatever legal remedies are available to me.

You say our compressor is ready then lets see it, drop it off this week, no more excuses!!!
