Florida Code sections 812 and 815, theft and fraud, cover your situation. You do not require the services of an attorney to file a lawsuit to recover your funds. You might have to pay the filing fees and charges to serve the defendant, but these fees will be much less than an attorney's fees.
 
I say tell as many people as you can about this until you get what you paid for. If you cant afford to nail this guy in court, nail his reputaion. What he is doing is not professional behaviour, it stinks. Get on every forum you can find, TDS, TSS, skoobatork, every yahoo club dedicated to scuba. Get the word out to stop this piece of **** doing this to anyone else.

It sounds like a discussion with the prosecuters office might be in order.

Just reading over the posts, I’m not sure I’d call it a scam. Since earlier systems were delivered and customers are happy, it sounds to me like Undersea Breathing Systems is experiencing difficulties meeting their deliveries. Bad business practices, maybe, but not a scam.

Did you have a written contract? Did it include a delivery date?

If I were you, AquaLogic, I’d keep pursuing legal action, and stop publicly slamming UBS before they counter-sue for defamation or slander. Would really add insult to injury if they file for bankruptcy (so you legally loose your money) then won a defamation judgment against you, and you had to pay them more.

Oh, and as mentioned earlier, get yourself and all involved listed with the BBB, then register complaints against UBS. Even if the BBB has no teeth, it would be ammunition in the courtroom.

Be careful, there’s a fine line between defamation and ‘warning other shops.’ Just reading your posts here, the whole thing had an “airing the dirty laundry” feel to it.

But what do I know... I am not a lawyer, nor did I sleep in a Holiday Inn last night.

Bring it on, maybe at least he would finally take me serious, I'm tired of playing games with this guy. Even if he is experiencing difficulties with delivery, why not just be upfront and honest. Ignoring people isn't going to make this all go away. I've spoken to quite a few people, there not as satisfied as you would like to believe.

I really don't want other people to go through the hell we have. I think a year is a little long to wait for equipment, and yes we have everything in writing. Not that it means anything to them.

If a company takes money up front knowing they can't deliver (as evidenced by previous failures to deliver the same product) then they are committing fraud, plain and simple. D*mn shame, too, delivering nitrox without partial pressure blending really has the potential to increase safety.
 
When was the last time the company did any of this ? Lets say a year ago they ran into greif for one reason or another and from that point on looks like he is scamming but really is just fighting his current money problems ? Just a thought. As a back seat rider I would still do the class action to help with cost and it is a good way to prove their be more then one comapny that has had this happen to them. Also you DO NOT require a lawyer do it yourself.
 
As long as AquaLogic is telling the truth than it can not be considered "defamation or slander". Waiting that long for equipment with no response to requests by all possible means and informing people what you are going through is not defamation or slander. You can be as snotty or as mad as you want that also is not defamation or slander.
It does sound to me that it is more an issue with being able to meet deliveries but if this is the issue than he should be a man about it and be up front. He is a piss poor business man and if the quality of his product is anything like the quality of his service than I would run fast the other way. This is based on the comments of AquaLogic. I'm only hearing a one sided story without hearing the other side and can base my opinion on this only.

I agree 100%.

What I was saying is that by stating that UBS is intentionally scamming, AquaLogic may be over the line.

I also agree with what Azza said about getting on all the boards, but only after all legal path's have been followed. Since this thread is AquaLogic's first visit to the board, I think I can assume that this is a course he has already decided on.

Well the last known person that this has happened to is back in Japan, and I was just notified that he's having problems with Delp. But things started going bad about 3-4 years ago. I did a little investagating myself and he has a handful of lawsuits out there right now, and from what I can tell it all started a few years back. If he's having money issues get a loan, oh yeah he is from us :(

Yes I am going to look into a class action lawsuit, amungst other things. Everyone has been giving great feedback and info., and it's been so helpful.

From what I heard last you do need a lawyer if it's over $10k, that's what the courthouse told me.

That's what we were told as well! And I would love to hear the other side of the story from DELP!
