Gosh, since you know that (a) the person is a jerk and (b) he's already stopped using your work and (c) you probably can't prove that he financially gained much by his use of your work (upon which a settlement would be based), you have the following options...

1) Chalk it up to a life experience and don't sweat the jerks in this world, or
2) Follow up with an attorney to make the attorney more money, you poorer, be a small pita to this guy and perhaps receive moral satisfaction, or
3) Hire some guy in a bar to beat the crap outta the guy (sorry, been watching too much Sopranos lately...) :eyebrow:

Good. Makes no difference to me as the life of thr author would be mine, but I'm sure the kids will love it. As I said, I'm a bit behind, for legal issues I usually hire an attorney.
 
also one additional question i would ask that guy is the name of the attorney that gave out that advice because they should lose the bar certification
 
Why not post his name, email, and phone?

His biz card says he's in the dive industry. What better way to show this guy for the sleazebag he is?

Also, if he's in the biz of selling antique dive equipment, why can't he come up with pics of his own?

The more devious might want to ensure that his email became known to the porn spammers and that his fax seemed to be getting slammed 24/7. Perhaps a few hundred magazine subscriptions might enlighten him?

He may have *said* there was an attorney that gave him that advice....But....

OK, redesigning them is a step in the right direction.
But I do have one more question. What does your lawyer say about pictures that are copyrighted? In the original photo, from where ever you got it from, my copyright was just below the divers hand. Where did that go? And his he sure they are also included in the free game deal? From my information source there are pictures that you can use, and pictures that you cannot use.

intresting this dirt bag has no morals, also could i know his isp, because this definately has to be a violation of his terms of service and grounds for termination of service. the other on is find out they printer that did this because they should have gotten a release to use that artwork, i know this from personal and professional reasons for i had to get one for the old cards i had made and then have done the same to others when working on theres to double check to make sure.

That's the thing too. Would you want a cute picture of you child in the tub on an adult web site? I think not. A bit extreme, I know. But I want to determine when and where my pictures are used.

Actually Europe has excellent if not the best copyright protection. Artists will get compensated when their work resells (at an auction years after creation, for example), retain the right to show their work collectively (sold work will be made available for a public display) and much, much more.
Does that mean if I move back to Europe I would have better chances :eyebrow:

One of the great things about being retired is that I have all the time in the world to deal with people like that
I'm lucky to have 4 days off a week (is that then half retired?)...might be just enough time to look into it :wink: .

The amazing thing about this is that if he had just approached this like a decent person and asked you ahead of time, I'd imagine that you would have been willing to work out a fair price to use your pic. Heck, that's flattering that someone wants to use your work to advertise their business. Or, even if he had then replied to your letter apologizing, saying that he didn't realize he was using your stuff, or something, then the desire to take him to court would not be that great.

I'm still going back and forth - should I/shouldn't make his name public....
