Unfortunately there was no signature UPS just left it on the porch as they usually do around here.
 
This really stinks.
Why is he making you wait two weeks? Obviously they erred in sending the package to the wrong address, the fact that you USED to live there is barely relevant (it's a good excuse for the mess-up, but hardly grounds to accuse YOU of any wrongdoing!)

If the vendor is in the same state as you are, then small claims court is probably your best route if nothing materializes in two weeks. If he's out of state, I have no idea how the rules apply, but I'm guessing that it's not as easy to file a suit unless you're willing to travel to the city in which the vendor does business (I did a *little* bit of checking in to this during my dispute with my LDS).

As other people have mentioned, whenever possible, conduct transactions like this with a credit card - they'll help you out in cases like these. I don't know if the USPS could help at all since you used their service to pay for something that didn't arrive - I wouldn't be surprised if they can, but that's pure speculation on my part.

UPS screwed up - an insured package should'nt be left at the doorstep. But again, that's between the dive shop and UPS - not you. This "two week wait" business is a bunch of hooey.

I've been lurking this one for a while, it IMHO it's time to bump it up a notch.

See Rick Murchison's original post on this thread: this shouldn't be about you, it should be about UPS and the (not so L) DS who sent the stuff.

I wouldn't wait another two weeks. I wouldn't wait two days. Call the guy back. Stick to the point that you ordered an item, you paid for it, and you didn't recieve it. Anything else is between other parties and you are not involved. Tell him that (nicely, don't get upset). If he insists on you waiting, let him know that he has left you with no option other than to contact the Attorney General of your state to expolore your other options.

My 2 cents (on VISA or MasterCard, never cash online).
 
Thanks for all the suggestions. I have got the impression that this company thinks of it's self as all powerful. No matter what I suggest he seems to think that he will do it by his terms and that's all there is to it. I will wait the 2 weeks and then I will file a small claims and post the companies name just as he suggested if my money is not in hand. I admit that they do have a great feedback from customers. As long as everything goes fine with your order I guess your in the clear but if they mess up your screwed.
 
I buy off eBay all the time but only minor stuff, bags, knives, back up regs, etc... I've encountered problems but usually with not as advertised. I always ask for insurance if it's over $50 just in case...
 
On Wednesday I called and asked about my money as that was the two weeks that the manager had promised me that I would have my money. They confirmed my worst thought, I asked if they had sent it to the old address like they did the package and guess what they did. Talk about incompetents, this place absolutely amazes me. He told me that he would next day the money to me and cancel the old one. So today I finally got my money which I am happy about but the fact that it took almost two months and the fact that they guaranteed me more than one time that I would have it by a certain date and each time they fell through is absolutely outrageous. I'm mad that it took so long to get my money but it irritates me more that they couldn't even honor their guarantees.

Still they said they could not until UPS confirmed they had the package back. They guaranteed I would have my money back within 2 1/2 weeks which passed the middle of last week. I emailed them on Thursday and said they needed to send my money back. They have still not replied so I filled out a form for eBAY's fraud protection and left negative feedback for them. UPS contacted me tonight since this was the second trace put on the package and they still have not got the package. If they do not send my money back is there any other recommended course of action I should take. I would also like to know if you think my current actions have been called for or do any of you think that I should have to wait till they get the package back. I have not listed the dealer because I don't know if that would open me up to any legal actions. They received my money order on 5-20-02. I was also curious if I might have any course of action through USPS as that is who I purchased the money order through.

.......That you have recieved satisfaction. I myself have mailordered the majority of my gear, via the web and mail order, and without mentioning names, It seems one company always has the equip. I want and at the best price, unfortunatly, I always, (never more!) have problems with them. I paid substantially more money for expediate shipping to make a dive trip, only to not recieve it but when brought to there attention, they, said I had to pay more for their mistake. (long story short)
I had to threaten them with legal action, to achieve any satisfaction, and still was out the original/additional shipping costs. And like yourself,(sounds like) I spent a fortune with these guys. I wish you the best, and hope you where not like me and needed this equip. before now.:(
