It is definitely an M16. the barrel is too long to be an AK47, and it also has the top handle/rear site.

It's definitely not an AK, but I don't believe it is an M-16 either. Kinda reminds me of an HK, not the MP-5 type but the big one. Doesn't really matter: poor choice of weapon to challenge whatever he mis-judged to be a fair match.
