Official Rules
1. Purchase Requirement: No Purchase Necessary. A PURCHASE OR TRANSACTION WILL NOT IMPROVE YOUR CHANCES OF WINNING.
2. Eligibility: Open only to legal residents of the United States and the District of Columbia. You must be over the age of 18 at the time of registration to enter. See item 13 for affiliated people restrictions.
3. Applicability: Void where prohibited by law.
4. By entering this Sweepstakes, you agree to receive special offers and promotions via email from Holiday Diver and its companies/partners.
5. Time Period: The Sweepstakes begins at 10 AM EST, October 31, 2006 and ends at 11:59 PM EST, January 31, 2007. For purposes of these Official Rules, all times are Eastern Standard Time (EST). All entries must be completed on-line or received by this ending time and date.
6. How to Participate: To enter the sweepstakes you must register by logging on to DiversDirect.com (A HOLIDAY DIVER, INC. COMPANY), click the WIN A SEADOO ZS07 EXPLORER UNDERWATER SCOOTER sweepstakes banner, and accurately and completely complete the registration form. Incomplete or inaccurate forms will be purged.
7. Limitations on Entry: Only one entry per person will be considered for the drawing. Multiple entries will be purged.
8. Limitations on Winners: Only one prize will be awarded. If a winner is selected, but fails to respond or does not accept the prize, the entry will be purged, and a replacement drawing will take place.
9. Obligations: HOLIDAY DIVER, INC., and it related companies are not responsible for lost, interrupted or unavailable network, server or other connections, miscommunication, failed phone or computer hardware or software or telephone transmissions or technical failures, garbled or jumbled transmissions or other errors of any kind, whether human, mechanical or electronic; including without limitation the incorrect or inaccurate capture of entry information online, or for lost, late, incomplete, damaged, destroyed, delayed, stolen, misdirected or illegible entries. Entry materials/data which have been tampered with or altered are void. Once submitted, entries become the sole property of HOLIDAY DIVER, INC. and will not be returned. In case of dispute as to identity of a winner who entered online, such entry will be declared made by the registered user of the e-mail account, and if a prize is won, and such registered user is a valid entrant, the prize will be awarded to such registered user.
10. Winner Drawing: Winners will be selected in a random drawing on or about February 3, 2007. The drawing may be conducted by HOLIDAY DIVER, INC., its agents, an independent law firm or CPA firm of HOLIDAY DIVER, INC.'s choosing. The drawing will be done electronically through a randomize program. By participating, entrants agree to these Official Rules and the decisions of HOLIDAY DIVER, INC., which shall be final and binding in all respects.
11. Winner Notification and Deadlines: The Winner will be notified via telephone or electronic mail as obtained from the registration information, and will have 21 business days from date of receipt to contact HOLIDAY DIVER, INC., complete the claim form and other documents as specified in the section "Conditions of participation", and transmit them via fax to HOLIDAY DIVER, INC. (with originals to follow by mail). HOLIDAY DIVER, INC. will then ship the prize claim information to the Winner. Should the Winner fail to comply with these requirements or otherwise be unable to accept delivery of the prize, the Winner will forfeit the prize and it will go to the first alternate in line.
12. Odds of Winning: The odds of winning are dependent upon the number of persons registering for the sweepstakes.
13. Value of Prize and IRS Reporting: The winner will be required to complete a claim form, including the collection of social security number (in the event that the prize has a value in excess of $600.00), to ensure appropriate government reporting. The value of the prize is determined using the prize's ARV (Approximate Retail Value) which is $799.99 (US). Any and all taxes assessed on each prize shall be the responsibility of each Winner. Winners shall not be entitled to cash equivalents under any circumstances.
14. Eligibility: Employees or agents of HOLIDAY DIVER, INC., its respective parent companies, affiliates, subsidiaries, advertising/promotional agencies, vendors, and the members of their immediate families or those persons living in the same household of such individuals are ineligible to enter or win. All federal, state and local laws and regulations apply. Void where prohibited by law.
15. Conditions of Participation: All winners will be required to sign and return an Affidavit of Eligibility, a Liability Release, and, where legally permitted, a Publicity Release, as part of the prize claim procedure. In the event of non-compliance with these requirements, winner may be disqualified and an alternate winner selected. HOLIDAY DIVER, INC. reserves the right, in its sole discretion to cancel, terminate, or suspend this Sweepstakes should viruses, bugs, unauthorized human intervention or other causes beyond the control of HOLIDAY DIVER, INC., corrupt or impair the administration, security, fairness, or proper play of the Sweepstakes. In such event, the winner for any prize for the month of cancellation will be selected by random drawing from all eligible online entries received up to the time of such cancellation, termination or suspension.
16. Release of Liability: By participating, entrants release HOLIDAY DIVER, INC., its respective parent companies, affiliates, subsidiaries, advertising/promotional agencies, vendors, and the employees, officers, directors and agents of any of the above organizations from any and all liability for any injuries, losses, or damages of any kind caused by participation in the Sweepstakes or the acceptance, possession or use/misuse of a prize or participation in any prize-related activities. Where legal, by accepting prize, winner grants permission to use his/her name, address, likeness, photograph, and statements by HOLIDAY DIVER, INC. for advertising/publicity purposes without further compensation. Winner specifically acknowledges any and all rights to his/her appearance on any television or radio advertisement as the sole property of HOLIDAY DIVER, INC. and winner will receive no further compensation relative to airing, broadcast or rebroadcast of such performance. By entering this Sweepstakes you represent and warrant that you have the authority to provide the registration information, that it is accurate and complete, and that you understand and hereby authorize use of all or any part of such information for any purposes in connection with this Sweepstakes. For online entries, such use may include but is not limited to HOLIDAY DIVER, INC. and third party marketing research and referrals. If you have elected to enter by hand-printing and mailing your 3" X 5" card entry, then your registration information will not be used for other purposes.
