(CBS) NEW YORK An Applebee's restaurant in New York City gave a 5-year-old boy a beverage he won't be able to drink legally for another 16 years. The boy's mother is taking Applebee's to court.

Cynthia Pereles can't understand how someone put Long Island iced tea into her son Seth's kiddie cup instead of the apple juice he ordered.

Seth took two sips and immediately spit it out, but then he couldn't stop laughing and started licking bread baskets.

Paramedics took Seth to the hospital to be rehydrated and he is okay.

But his mother is suing for $75,000.

"I think that they handled it in a really unprofessional and they just showed no care no concern whatsoever," Cynthia Pereles said.

Applebees admitted the mistake, but had no comment on how Seth could have been served alcohol.

The first time I ever tasted alcohol was when I was 8 yrs old. My younger brother was drinking apple juice and told me he was drinking beer so I should join him. I opened the fridge and pulled out my dad's 6 pack of carlsberg...I wasn't too bright back then.

Heheheh :rofl: :rofl:, perhaps I shouldn't laugh but the image of a 5 yr old compulsively licking bread baskets is hilarious.

Why the need for the lawsuit though, because the 'incident' wasn't handled properly?
I'm sure that this is not a common occurence at applebee's and I really don't see what filing a lawsuit will solve.
Oh well i'm sure there will be a settlement resulting from this.

Hmmm, I remember when I was younger my parents and their friends talking about putting a tip of rum in their kids drink to calm them down at night and put them to sleep.

As to New York, you gotta love the place :D.

Thats nothing. When I was just shy of 4 years old, my parents found me under the table, sharing a can of beer with my 9 month old sister! I've also managed to convince that sister (when she was older) to do things like put her tongue on the back of the freezer (it got stuck!), and stand on the other side of the pool when I was going to throw the cat in (it pretty much bounced off the water, swiped her and ran off for a while).

at the BACK of the freezer?!?!?!? That's so money! You must have written the prologue in "the older brother's guide to pranking"!
