I wait until I'm in the water to pee since I'm not too fond of peeing in the boat lavatory. I pee pretty much every dive at least once except the first one. I try not to pee when someone is below me but hey, I'm only human.
I'm only going about 30 feet deep maybe 300 feet from shore. I have a buoy and there isn't much boat traffic in the area at all.

I know one dive shop that always lists the visibility as 100+ feet. I have dove in the area frequently and have yet to encounter visibility past 60 feet so I'm wondering where they could possibly be diving. Of course I don't believe a word they are saying and don't dive with them anymore.
If they want the business and they can match the price point then yes they can. Should they? That is entirely up to them. It is good business etiquette to do so providing the previous criteria can be met. Customers tend to be loyal and getting a loyal customer early can really pay dividends.
