I think this was a lesson for captains...
So far as I can tell, this teaches Captains not to trust DM's they don't personally employ...
Unfortunately, if the DM didn't get penalized, it taught the DM that he can make major mistakes and not suffer consequences...But I would think we don't...
You may want to reconsider your wording....The "higher amount at verdict" is only one of many costs to be considered....The defense also factors in the cost of the litigation itself...Most cases never hit the courtroom, and only a tiny fraction of those ever get to appeal.

I think the first question is moot, and the one above is answered by the fair negotiation being completed...She was satisfied with what she received...Could you argue something to get in front of a judge....who knows...Is it worth it? (are ya willing to risk a few thou?)

I've been quite lucky...Dived twice each of two days weeks apart at Catalina and saw Black Sea Bass both sets of dives...
The first time I saw one, it scared the daylights out of me...and I had no clue what it was...I just knew it was BIG....

For outside the bay...
SAT NIGHT AND SUN
N WINDS 25 TO 35 KT. COMBINED SEAS 11 TO 13 FT.
Above 9 or ten outside of the bay is most often too much to dive in...
Inside the bay is supposedly gonna look like this:
