I would imagine that a night dive would include a guide so no buddy would be necessary. Most of my diving is boat dives with outfits who provide a guide automatically, day or night. You probably would lose a buddy right away in the dark anyway. All daylight dives off of a boat which I have done...

Most shore property in the Keys is privately owned. What few beaches there are are man-made since it is all coral and you'd probably have to be a customer of a hotel to use a beach if you found one. There are also laws about what minimum distance from the shore in which you are allowed to dive.

If I was an instructor who was being sued by the 'shotgun" approach I'd probably sell out and head for the Cayman Islands, Fiji, British VIrgin Islands or maybe Bermuda and start over again. I doubt that I would be bothered with a warrant in any of these places. You could return in 7 years...
Air tank, back plate, regulators, 'flippers' and goggles. Anything else, like a cert card, BCD, compass, computer, safety pack, etc. is unnecessary but may be obligatory to make the local dive operator happy and let you on the boat.
